Bed Capacity Cap in South Tyrol
The South Tyrolean Provincial Government approved the implementing regulation on the bed capacity cap on September 13, 2022. The first step is to conduct a survey of all beds in the province. The implementing regulation stipulates that for hospitality establishments that were in operation as of December 31, 2019, the bed capacity limit will be determined based on their license or the duly reported overnight stays as of a freely selectable date in 2019. Legal Background
Excerpt from Provincial Government Resolution No. 661 of September 13, 2022:
The legal representative of the business or the owner or holder of a right of usufruct or use of the hospitality property may apply to the municipality by March 31, 2023, for an increase in the number of beds specified in the permit. This increase may not exceed the number of duly reported overnight stays by guests over the age of 14 on any freely selectable reference date in 2019, as determined in accordance with Article 44 of Provincial Law No. 58 of December 14, 1988, as currently in force. The application must be accompanied by a statement specifying the reference date and the number of registered overnight stays by guests over the age of 14 on that reference date in 2019.

Procedure at ASA HOTEL
To assist all South Tyrolean businesses in applying for an increase in the number of beds, the new version of ASA HOTEL introduces a new line command to determine the day with the highest number of overnight stays and the number of guests aged 14 and older. Under Hotel/Periodic Activities/Tourist Tax, enter data for the entire year 2019 and execute the line command (separately for each tourist tax-registered business) “Maximum reported overnight stays.”
